HIPAA RIGHTS FOR GENESIS CLIENTS

You may file a complaint about our Privacy Procedures:

If you believe that your privacy rights have been violated or if you are dissatisfied with our privacy policies and procedures, you may file a complaint either with us or with the federal government. We will not take any action against you or change our treatment of you in any way a complaint is filed.

The right to confidentiality under Federal confidentiality rules (45 C.F.R. Parts 160 and 164 - the “Privacy Standards” and 42 C.F.R. Part 2).
  1. Federal law and regulations protect the confidentiality of client records maintained by GENESIS. We may not
    say to a person outside the agency that you participate in services, or disclose any information identifying you
    as an alcohol or drug abuser or mental health client unless:
  1. Federal laws and regulations do not protect any information about suspected child or elder abuse or neglect
    from being reported under State law to appropriate State or local authorities.
  2. GENESIS has the right to search anyone if there is reasonable cause to believe that person has violated the possession of drugs/alcohol policy.
  3. The above Federal Laws do not protect my information if I am being investigated under the 2002 Patriot’s Act.
